The DEA Announcement
The idea of a Kratom ban is nothing new. In fact, the first public announcements of such a ban date back to 2016.
Back then, the DEA announced that it would classify Kratom as a Schedule 1 drug. This is the harshest classification, and it includes ecstasy, heroin, and LSD. Controversially, marijuana is also a Schedule 1 drug.
If such a ban went into place, it would become illegal to purchase or sell Kratom. So why are you still able to legally purchase Kratom all these years later?
It’s largely because the DEA ran into an even stronger force: the power of the people!
The DEA was surprised at the public pushback to their announcement. And the pushback wasn’t limited to Kratom users, either.
They also faced a great degree of criticism from scientists and lawmakers. Many of the scientists understood firsthand that Kratom had a number of medical benefits. And many of the lawmakers simply believe the choice of whether to use Kratom or not should be left to the people.
In reaction to this pushback, the DEA lifted their ban and solicited the FDA for more research into Kratom. They still planned to have a definitive ban decision by the end of 2016. Years later, though, the possibility of a ban is still an open question.
Things Slow Down
So far, we’ve focused on the DEA’s involvement in banning Kratom. For longtime Kratom users, however, the real enemy has been the FDA.
Why is that? The DEA really made Kratom a focus for about a year. Starting in 2017, though, the FDA took the charge and started trying to convince the DEA to ban Kratom by classifying it as a Schedule 1 drug.
And this is where things get a bit strange. After that initial push, it seems the DEA lost interest in pursuing a ban on Kratom. And for all the noise that the FDA continues to make about Kratom, the final decision will rest with the DEA.
Should This Be Under FDA Administration?
At this point, you probably have a simple question: why is the Food and Drug Administration worried about Kratom?
To hear the FDA commissioner tell the story, it is because Kratom is dangerous and that the FDA has a “public health obligation” to fight against it. And they claimed that because Kratom is often sold in capsule form, the substance inside was technically a food additive and subject to FDA scrutiny.
To put it mildly, this all seems outside the standard legal bounds of the FDA. They tried a similar ploy back in 1993, and the court struck down their attempts to expand their own power.
Ultimately, the FDA may or may not get their way when it comes to Kratom. And that makes the Kratom Consumer Protection Act more important than ever.
Enter the Kratom Consumer Protection Act
What is the Kratom Consumer Protection Act (also known as the KCPA)? This is a compromise between users and the federal government that many Kratom enthusiasts support.
Basically, the KCPA would ensure that buying and selling Kratom remains legal. At the same time, this act allows the government to help regulate Kratom and potentially ensure the safety and quality of the final product.
The KCPA would also allow compliance with the FDA in a number of key areas. For example, if the FDA is truly worried about dangerous additives within Kratom, this act would allow them to inspect everything before it is sold. And the FDA could even put as many informative labels and warning labels on Kratom products as they felt necessary.
Why the KCPA Is Necessary
Beyond simple regulation, the real goal of the KCPA is much simpler. It’s all about raising awareness of the potential uses of Kratom and breaking down the boundaries that come from myths and assumptions about the product.
